Allmänna villkor – Winsty

1. INLEDNING

Dessa allmänna villkor (“Villkor”) reglerar din tillgång till och användning av mobilapplikationen Winsty och tillhörande tjänster (“Tjänsten”), som drivs av Winsty AB, org.nr 559386-5776 (“Winsty”, “vi”, “oss” eller “vår”).

Genom att skapa ett konto, ladda ner appen eller använda vår Tjänst godkänner du att vara bunden av dessa Villkor. Om du inte godkänner Villkoren får du inte använda Tjänsten.

2. BEHÖRIGHET OCH KONTO

2.1 Behörighet

För att använda Tjänsten måste du:

  • Vara minst 15 år gammal eller ha vårdnadshavares godkännande

  • Ha rätt att ingå avtal

  • Inte vara förbjuden enligt lag att använda Tjänsten

  • Inte tidigare ha blivit avstängd från Tjänsten av oss

2.2 Kontoansvar

Du samtycker till att:

  • Lämna korrekt, aktuell och fullständig information om dig själv

  • Upprätthålla säkerheten för dina inloggningsuppgifter

  • Inte dela ditt konto eller dina inloggningsuppgifter med andra

2.3 Otillåtet beteende

Du får inte:

  • Utge dig för att vara någon annan

  • Lämna falska eller vilseledande uppgifter

  • Trakassera, mobba, kränka, hota eller skada andra användare

  • Använda Tjänsten för olagliga ändamål eller vilseledande, påträngande eller oönskad marknadsföring

  • Missbruka Tjänsten för spam, bedrägerier eller trakasserier

Med “oönskad marknadsföring” avses exempelvis massutskick av reklam, spam, försäljningsförsök eller påträngande annonsering som mottagaren inte har bett om.

3. TJÄNSTEN OCH ANSVARSFRISKRIVNING

3.1 Tjänstens funktion

Winsty är en digital plattform för sportrelaterade profiler, klubbar, möjligheter och kommunikation mellan användare.

Information som visas i Tjänsten kan baseras på både användargenererat innehåll och offentligt tillgängliga sportuppgifter. Vi kan inte garantera att all information är fullständig, korrekt eller uppdaterad.

Du ansvarar själv för att granska och uppdatera dina uppgifter i appen.

3.2 Kommunikation och innehåll

Winsty ansvarar inte för innehåll, åsikter eller uttalanden som delas mellan användare i chattar, profiler eller inlägg.

3.3 Beta-status

Tjänsten är i beta-stadium. Vi garanterar inte specifik upptid eller felfri funktionalitet under denna fas.

4. INNEHÅLL OCH DATAANVÄNDNING

4.1 Licens

Genom att publicera innehåll (t.ex. bilder, texter eller profiler) ger du Winsty en icke-exklusiv rätt att visa, lagra och använda innehållet för att driva Tjänsten.

4.2 Ansvar

Du ansvarar själv för det innehåll du publicerar och att det inte bryter mot lag eller tredje parts rättigheter.

4.3 Rapportering

Om du stöter på innehåll som bryter mot dessa Villkor, är olämpligt, kränkande eller gör intrång i upphovsrätt, uppmanar vi dig att rapportera det till oss.

Vi förbehåller oss rätten att granska, ta bort innehåll och vidta åtgärder mot konton som bryter mot reglerna.

5. KOMMUNIKATION OCH CHATT

Du ansvarar själv för hur du kommunicerar med andra användare.

Winsty ansvarar inte för privata konversationer mellan användare.

Vi förbehåller oss rätten att granska och moderera innehåll vid misstanke om regelbrott.

6. SÄKERHET

Winsty AB genomför inte brottsregisterkontroller. Du interagerar med andra användare på egen risk.

7. UPPSÄGNING OCH AVSTÄNGNING

Vi förbehåller oss rätten att omedelbart stänga av eller avsluta ditt konto om du bryter mot dessa Villkor, rapporteras för olämpligt beteende eller bedöms vara en falsk profil.

8. ANSVARSBEGRÄNSNING

I den utsträckning det är tillåtet enligt svensk lag ansvarar Winsty AB inte för indirekta skador.

10. TVISTLÖSNING

10.1 Tillämplig lag

Svensk lag ska tillämpas.

1. INTRODUCTION

These General Terms and Conditions (“Terms”) govern your access to and use of the Winsty mobile application and related services (“Service”), operated by Winsty AB, reg. no. 559386-5776 (“Winsty”, “we”, “us” or “our”).

By creating an account, downloading the app or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. ELIGIBILITY AND ACCOUNT

2.1 Eligibility

To use the Service, you must:

  • Be at least 15 years old or have parental/guardian consent

  • Have the legal right to enter into an agreement

  • Not be prohibited by law from using the Service

  • Not previously have been suspended from the Service by us

2.2 Account Responsibility

You agree to:

  • Provide accurate, current and complete information about yourself

  • Maintain the security of your login credentials

  • Not share your account or your login credentials with others

2.3 Prohibited Conduct

You may not:

  • Impersonate another person

  • Provide false or misleading information

  • Harass, bully, insult, threaten or harm other users

  • Use the Service for illegal purposes or for misleading, intrusive or unsolicited marketing

  • Abuse the Service for spam, fraud or harassment

“Unsolicited marketing” refers, for example, to mass distribution of advertising, spam, sales attempts or intrusive advertising that the recipient has not requested.

3. THE SERVICE AND DISCLAIMER

3.1 Function of the Service

Winsty is a digital platform for sports-related profiles, clubs, opportunities and communication between users.

Information displayed in the Service may be based on both user-generated content and publicly available sports data. We cannot guarantee that all information is complete, accurate or up to date.

You are responsible for reviewing and updating your information in the app.

3.2 Communication and Content

Winsty is not responsible for content, opinions or statements shared between users in chats, profiles or posts.

3.3 Beta Status

The Service is in beta stage. We do not guarantee specific uptime or error-free functionality during this phase.

4. CONTENT AND DATA USE

4.1 License

By publishing content (e.g. images, text or profiles), you grant Winsty a non-exclusive right to display, store and use the content for the purpose of operating the Service.

4.2 Responsibility

You are responsible for the content you publish and for ensuring that it does not violate the law or the rights of third parties.

4.3 Reporting

If you encounter content that violates these Terms, is inappropriate, offensive or infringes copyright, we encourage you to report it to us.

5. COMMUNICATION AND CHAT

You are responsible for how you communicate with other users.

Winsty is not responsible for private conversations between users.

We reserve the right to review and moderate content in case of suspected violations of the rules.

6. SAFETY

Winsty AB does not conduct criminal background checks. You interact with other users at your own risk.

7. TERMINATION AND SUSPENSION

We reserve the right to immediately suspend or terminate your account if you violate these Terms, are reported for inappropriate behavior or are considered to be a false profile.

8. LIMITATION OF LIABILITY

To the extent permitted by Swedish law, Winsty AB shall not be liable for indirect damages.

10. DISPUTE RESOLUTION

10.1 Governing Law

These Terms shall be governed by and construed in accordance with Swedish law.

10.2 Disputes

Any disputes arising from these Terms shall be settled by a Swedish court, with the Stockholm District Court (Stockholms tingsrätt) as the court of first instance.
